Terms of Service
Last updated: 2 October 2026 · Operated by Hectic Software Ltd, United Kingdom
These Terms govern your use of the Hectic Music website, apps and services (the “Service”), which is operated by Hectic Software Ltd, United Kingdom (“Hectic Music”, “we”). By creating an account or using the Service you agree to them. If you do not agree, please do not use the Service.
1. Eligibility and accounts
You must be at least 13 years old to use the Service; the Service is not for children under 13. If you are under 18 you confirm a parent or guardian is aware you use it. You must be 18 or over to receive payouts. You are responsible for your account, for keeping your login secure, and for activity under it. Give us accurate information and keep it up to date.
2. Your content and licence to us
You own the content you upload, import or post (“Your Content”). You give Hectic Music a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transcode, format, display and distribute Your Content, and to make it available to others as you choose, solely to operate, secure, promote and improve the Service. The licence ends when you delete Your Content, except for backups, copies already shared by others in line with how the Service works, and copies we must keep to comply with the law or for moderation and appeals.
You promise that you own or have the rights needed to grant this licence and that Your Content does not infringe anyone’s rights or break the law.
3. Third-party and embedded content
Where you embed or link to content from other platforms (such as YouTube), you must have the right to do so and follow their terms. That content is served by the third party under their terms and privacy practices.
4. Prohibited content and conduct
You must not use the Service to post, share or promote:
- content that is illegal in the United Kingdom, including child sexual exploitation and abuse, terrorism, threats and incitement to violence, harassment and stalking, hate crime, fraud and scams, and non-consensual intimate images;
- content that infringes copyright or other intellectual property rights;
- content that promotes or glorifies self-harm or suicide, or graphic violence presented for shock;
- impersonation, spam, or deliberately misleading content;
- malware, or any attempt to breach security, scrape the Service, overload it, or evade rate limits, blocks or moderation.
See our Community Guidelines for detail.
5. Reporting illegal content
If you see content you believe is illegal or breaks these Terms, report it as described on our Safety & Reporting page or email support@hecticmusic.co.uk. For copyright, see our Copyright & DMCA page. We act on illegal content when we become aware of it, and may preserve it and share it with law enforcement or Ofcom where the law requires.
6. Moderation, enforcement and appeals
We may hide or remove content, restrict features, suspend or terminate accounts where content or conduct breaches these Terms or the law. Where we do, we will tell you what we did and why unless the law or an investigation stops us. Repeat infringers will have their accounts restricted or terminated. You can appeal under our Appeals Policy. We may use automated tools as well as human review to help find or prioritise reports; a person reviews appeals.
7. Our rights in the Service
The Service, including its software, design and trademarks, belongs to us or our licensors. Except for Your Content, these Terms give you no rights in it beyond a personal, non-transferable right to use the Service as intended.
8. Payments and monetisation
Memberships and creator payouts, where available, are processed by Stripe and subject to its terms. Creators are responsible for their own taxes. We may withhold or reverse payments in cases of fraud, chargebacks or serious breaches of these Terms. Your statutory rights as a consumer, including any right to cancel and refunds for faulty digital content, are not affected.
9. Suspension, termination and deleting your account
You can stop using the Service and delete your account at any time under Settings → Delete account. We may suspend or end your access if you breach these Terms, if we are required to by law, or to protect users or the Service. Terms that by their nature should continue after termination will do so.
10. Our responsibility to you
The Service is provided with reasonable care and skill, but we cannot promise it will always be available, uninterrupted or error-free. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded by law, and nothing affects your statutory consumer rights.
Subject to that, we are not liable for loss that was not a reasonably foreseeable result of our breach, for loss of profit, business or opportunity (if you use the Service for business purposes), or for loss of content caused by events outside our reasonable control. For consumers, our total liability for losses arising from our breach or negligence is limited to the greater of the amount you paid us in the 12 months before the claim and £100, except where the law does not allow that limit.
You are responsible for Your Content. If a third party brings a claim against us because of Your Content or your breach of these Terms, you agree to reimburse our reasonable losses to the extent the claim arises from your breach.
11. Changes to these Terms
We may update these Terms, for example to reflect changes in law or the Service. We will post the new version with a new date and give reasonable notice of material changes. If you do not agree to a change you can delete your account.
12. Governing law and disputes
These Terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, but if you are a consumer living elsewhere in the United Kingdom you may also bring proceedings in your local courts, and mandatory consumer protections in your country of residence continue to apply.
